La causa ESMA es considerada una de las llamadas “mega-causas” por el alto número de víctimas e imputados que nuclean las investigaciones. Dada la magnitud del expediente, el juez federal de primera instancia Sergio Torres ha dispuesto que la investigación avance en forma fragmentada, según diferentes criterios, dividiendo la causa en partes que involucran a diferentes imputados y corresponden a diferentes víctimas y hechos.

Al mes de mayo de 2009, ya han sido elevadas a juicio ocho partes del expediente. Cinco de esas partes se unificarán en el que será el segundo juicio por la causa ESMA, que se espera comience el 11 de diciembre de 2009 de este año. Debe recordarse que una primera elevación, que llegó a juicio en diciembre de 2007, enmarcaba hechos de tortura que habrían sido cometidos por el prefecto Héctor Febres alias “Selva”. Lamentablemente, su muerte prematura días antes de la lectura de la sentencia impidió que el juicio llegue a término, y las actuaciones quedaron nulas.

Existen cuatro partes de la causa que han tramitado separadas del expediente principal desde un principio. Se trata, en principio, de la conocida como “Testimonios B” – donde se investigan los secuestros de un grupo de familiares y Madres de Plaza de Mayo que, junto con las monjas francesas Leonie Duquet y Alice Domon se reunían en la Iglesia Santa Cruz – y “Testimonios C”, relativa al asesinato de Rodolfo Walsh, así como del robo de su obra inédita. Estas dos serán parte del juicio que iniciará en octubre. Luego, existen dos tramos más que investigan la apropiación de los bienes de los detenidos-desaparecidos alojados en dicho centro clandestino durante su cautiverio. Pero, además, el expediente principal ha sido a su vez dividido en 4 tramos o elevaciones parciales: el denominado “Testimonios A”, que nuclea las primeras actuaciones que se realizaron en la causa, retomando las investigaciones de los años 80; un pequeño número de hechos que se le imputan al capitán de fragata (r) Adolfo Donda Miguel; uno similar al anterior pero que tiene por imputados al vicealmirante (r) Oscar Montes y al capitán de corbeta (r) Carlos Octavio Capdevilla; y, finalmente, el que nuclea hechos del año 1976. Los primeros tres serán también parte del juicio próximo a iniciarse.

Actualmente existen 148 implicados en esta causa. De éstos, 63 se encuentran procesados, 59 de ellos cumpliendo prisión preventiva. El 60% de éstos se encuentra alojado en el complejo penitenciario de Marcos Paz, mientras que aproximadamente el 35% cumple arresto domiciliario.

Clandestine Center ESMA

ESMA cause is considered one of the “mega-causes” by the high number of victims and former perpetrators which are involved in the investigations. Given the magnitude of the file, first instance federal judge Sergio Torres has arranged that the investigation advances in a fragmented way, according to different criteria, dividing it in parts which involve different perpetrators and correspond to different victims and facts.
Up to May of 2009, eight parts of the file have been elevated to trial. Five of these parts will be unified in ESMA’s second trial, which will start in December 11th. One first elevation, which trial was being celebrated in December of 2007, framed torture facts that would have been committed by the prefect Héctor Febres alias “Selva”. Unfortunately, his premature death days before the reading of the sentence prevented that the judgment arrives upon maturity, and the performances were null.

There exists other four parts of the ESMA cause which have transacted separated of the main file from the beginning. One is known as “Testimonies B” and refers to the investigation of the kidnappings of a group of people who used to meet at the Church Santa Cruz (detainees-disappeared relatives and Mothers of Plaza de Mayo), along with the ones of the French nuns Leonie Duquet and Alice Domon. Another, known as “Testimonies C” is relative to the murder of the writer Rodolfo Walsh, as well as of the robbery of his unpublished work. These two will be part of the trial which will begin in October. Finally, the last ones refer to the appropriation of the goods of the detainees-disappeared which were held in captivity in this clandestine center.
In addition, the main file has been divided in 4 sections or partial elevations as well: the first one, called “Testimonies A”, which gathers the first performances that were made in the cause, retaking the investigations of years 80; another refers to a small number of facts that are imputed to the navy captain Adolfo Donda Tiguel; one similar to the previous one but that has been imputed to the vice-admiral (r) Oscar Monte and the navy captain (r) Carlos Octavio Capdevilla; and, finally, the one that investigates facts of the year 1976. The first three partial elevations will be also part of the next trial.

At the moment, there are 148 people implied in this cause. 63 of them are accused, 59 holding pre-trial detention. 60% of these are detained in the penitentiary complex of Marcos Paz, whereas approximately 35% fulfill house arrest.
