CELS unites with more than 180 human rights entities in the region in asking the Organization of American States to respect the independence and autonomy of the Inter-American Commission on Human Rights. In a letter (in Spanish) sent to the General Secretariat of the OAS, we requested the renewal of the contract of the current Executive Secretary of the IACHR, confirmed in the post unanimously by the Commissioners of the IACHR in January 2020.

Re: The OAS must protect the autonomy of the IACHR by renewing the contract of its Executive Secretary.
The signatory organizations express our deep concern over the unilateral decision of the Organization of American States (OAS) General Secretariat that invalidates the renewal process of the mandate of the Executive Secretary of the Inter-American Commission on Human Rights (IACHR). Far from strengthening the institutional structure of the IACHR, it is an unprecedented intervention that ignores and voids the autonomy and independence of the Commission.
The adoption of measures and regulatory reforms that ensure, in practice, the IACHR’s autonomy and independence was a conquest of both civil society and most of the States that are committed to strengthening the Commission. Despite the attempts to limit the IACHR’s status in recent decades, the dedicated work towards dialogue and consensus has made it possible to preserve and strengthen its freedom, ensuring the required attention be given to the serious situations that occur in our region and more effective responses to the victims of human rights violations.
One of the many results of these processes is the consolidated norm and practice that gives the IACHR a decisive role in the selection and renewal process of the executive secretary. The statute of the Commission, in turn, provides that any decision regarding the removal of the executive secretary must be duly justified and carried out in consultation with the commissioners. As can be seen from the public statement of the IACHR of August 25, 2020, the plenary session of the Commission was not consulted on the decision not to renew the executive secretary’s mandate in office; in fact, the Commission opposes the decision of the General Secretariat.
We acknowledge that one of the reasons alleged by the General Secretariat for taking this decision is a confidential report from the OAS ombudsperson on administrative complaints from officials and former officials of the IACHR, presumably related to the work environment. We affirm our commitment to work environments framed in the protection of rights and free from violence, and with the need to strengthen, both in the OAS and in the IACHR itself, suitable, transparent and respectful reporting channels for due process. The nature, content and volume of these complaints, which remain confidential, as well as the individual and institutional responsibilities they imply are still unknown. This jeopardizes any serious and committed debate with the victims.
Making the existence of this report public one day before the end of the executive secretary’s mandate to impose a decision on the IACHR creates an extremely serious precedent for the Inter-American Commission’s autonomy and independence and inaugurates an unprecedented political crisis. This act puts at risk the most basic consensus on the functioning of the Inter-American System and its relationship with the Organization of American States.
With the aim of restoring the autonomy of the IACHR, violated by unilateral action, the signatory organizations urge the Secretary General of the OAS to immediately carry out the procedures for the contract renewal of the Executive Secretary of the IACHR, so that progress may be achieved alongside the Commission, in the respect of transparency and due process, in the evaluation of the complaints and the determination of responsibilities and reparation measures.
